調查記者劉虎因誹謗罪被逮捕

中國當局打擊網路謠言的運動愈演愈烈。最近因"涉嫌尋釁滋事"被拘押的知名媒體人、調查記者劉虎現因"誹謗罪"被逮捕。其律師指出,劉虎涉嫌的所謂"犯罪事實"均是在網上舉報官員涉嫌違法違紀行為或轉發對官員的舉報信。

(德國之聲中文網)據廣州《新快報》調查記者劉虎的律師周澤證實,劉虎已於9月30日被檢方批准逮捕,罪名是誹謗罪。此前,劉虎於8月23日在重慶被抓並被送至北京。北京市公安局官方微博8月25日凌晨發布消息稱,劉虎因涉嫌製造傳播謠言被北京警方刑事拘留。

律師周澤表示,對劉虎的指控是"因言治罪",可能是當局對其舉報多名高官採取的打擊報復。7月29日,劉虎通過微博舉報國家工商總局副局長馬正其在重慶任區黨委書記期間涉嫌瀆職。之前,他還在網路上實名舉報上海高院代院長崔亞東有濫用職權的違法犯罪嫌疑,並將一名當事人舉報陝西省公安廳廳長杜航偉的舉報信通過自己的微博公開,要求國家機關調查核實。此外,劉虎還通過微博轉發過其他記者的舉報信,併發表或轉載過諸多揭露幹部違法違紀的微博。

"讓網民鴉雀無聲"

從8月以來,中國當局展開了一場"打擊網路謠言"的行動。一批知名的網路活躍人士-所謂的大V紛紛遭到整肅或受到壓力。由於擔心政權受到威脅或者社會不穩,中共再次收緊了對社群網站的控制,限制公眾討論敏感的政治問題。

Xue told police in a Beijing detention centre that online influence had fuelled his ego, adding that he had misled internet users on various incidents.

9月9日,中國"兩高"出台司法解釋規定,"同一誹謗訊息實際被點擊、瀏覽次數達到五千次以上,或者被轉發次數達到五百次以上的",應認定為"情節嚴重"的誹謗行為,可判處三年以下有期徒刑。

據媒體報導,劉虎的律師周澤表示,他認為中國政府對人民利用網路作為反腐工具感到不快。周澤還指出,劉虎的行為屬於行使公民的批評、建議、控告、檢舉等監督權利的行為。憲法對公民行使監督權的行為,不要求公民掌握百分之百的證據。

人權組織人權觀察的調查員瑪雅‧王(Maya Wang)表示:"在政府出台打擊網路謠言新法規後數周,一位知名的博主因誹謗官員被捕,這樣的訊息再清楚不過了。他們想讓本來就憂心忡忡的中國網民更加鴉雀無聲。"
